These Terms of Service explain the rules for using SimCharts.net, the SimCharts web app, and related services. They are intended to give users a real, readable summary of how the service may be used and where responsibility sits.
1. Acceptance of Terms
These Terms of Service govern your access to and use of SimCharts.net, the SimCharts web application, and related services, including the SimCharts Bridge application.
By creating an account, accessing the service, or using any SimCharts feature, you agree to these Terms. If you do not agree, do not use the service.
2. Eligibility and Accounts
You must be legally able to enter into a binding agreement in your jurisdiction to use SimCharts.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must provide accurate information when registering and keep your account details reasonably up to date.
3. Permitted Use
SimCharts is provided for personal flight simulation use only unless we explicitly agree otherwise in writing.
You may use SimCharts to view charts, manage simulated flight planning workflows, connect supported simulator tooling, and sync simulator-derived navigation data for your own use within the service.
You may not use SimCharts for real-world flight operations, dispatch, navigation, or any safety-critical aviation activity.
4. Prohibited Conduct
You may not misuse the service, interfere with its operation, attempt unauthorized access, reverse engineer restricted parts of the platform except where permitted by law, scrape the service at scale, or use the service to distribute malicious code.
You may not use SimCharts to violate third-party terms, intellectual property rights, export controls, or applicable law.
You may not share access credentials, abuse public endpoints, or attempt to bypass account, quota, rate-limit, or security controls.
5. Third-Party Data and Integrations
SimCharts may rely on third-party providers, including chart, weather, telemetry, or flight-planning services. Your use of those integrations may also be subject to the terms and policies of those providers.
ChartFox data, simulator-derived data, and other third-party content remain subject to their respective rights and restrictions. SimCharts does not grant ownership of third-party data to you.
If a third-party provider changes, suspends, or terminates access, some SimCharts features may become limited or unavailable.
6. Navigation Data and Simulator Sync
If you use SimCharts Bridge or similar sync features, navigation data may be read from your local simulator installation and transmitted to your SimCharts account to support in-app procedure and routing features.
You represent that you are authorized to use the local files and simulator environment from which such data is read.
Simulator-derived navigation data is used to power your experience within SimCharts and is not provided as a certified or authoritative source for real-world navigation.
7. Fees and Changes
Some SimCharts features may be provided free of charge. We may introduce, modify, or remove features, plans, or pricing at any time.
If paid features are introduced in the future, applicable pricing and billing terms will be presented separately before you are charged.
8. Availability and Updates
We may update, suspend, restrict, or discontinue any part of the service at any time, with or without notice.
We do not guarantee uninterrupted availability, error-free operation, or compatibility with every simulator version, operating system, or third-party service.
9. Intellectual Property
SimCharts, including its software, design, branding, text, graphics, and original content, is owned by SimCharts or its licensors and is protected by applicable intellectual property laws.
These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the service in accordance with these Terms.
10. Disclaimers
SimCharts is provided on an "as is" and "as available" basis to the maximum extent permitted by law.
We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
SimCharts is not approved for real-world aviation use. Do not rely on the service for real-world navigation, operational decision-making, or flight safety.
11. Limitation of Liability
To the maximum extent permitted by law, SimCharts and its operators, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business opportunity arising from or related to your use of the service.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the service or these Terms will not exceed the greater of the amount you paid us for the service in the 12 months before the claim arose or EUR 50.
12. Suspension and Termination
We may suspend or terminate your access if we reasonably believe you violated these Terms, created security or legal risk, abused the platform, or used the service in a way that harms SimCharts or other users.
You may stop using the service at any time. If you want your account deleted, contact us using the details below or use any available in-product deletion controls.
13. Governing Law
These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules, unless mandatory local consumer law requires otherwise.
Any dispute arising out of or relating to these Terms or the service will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date on this page.
Your continued use of SimCharts after updated Terms take effect constitutes acceptance of the revised Terms.
